so for justice stevens' liberty is not about formalism. quite the contrary, it's not about structure of government. what liberty is about is individuals. and it's about the individual's protection against arbitrary or oppressive governmental actions. in other words, the right to trial by jury is the right the defendant has to have his peers decide whether or not he is guilty of something and should be punished in a certain way. and so while i'm happy to sit here today and talk about ring against arizona which overturned walton and adopted justice stevens' solo dissent, in harris the court fell one vote short of that. and so i think my parting wish today would be that while justice stevens is still on the court, i think it would be a wonderful event for his dissenting opinion in mcmillan to be adopted by a majority and there's reason to believe it's possible. the concurring in harris justice breyer said "i agree with the disto jury trial as articulated does apply in these circumstances, too" because otherwise it wouldn't make any sense "but
